Your Asylum Questions, Answered

Straight answers to the questions asylum seekers in Miami ask us most. Every case is different — bring your timeline and documents to a consultation for advice on your specific facts.

You file Form I-589 — with USCIS if you are not in removal proceedings, or with the immigration judge if you are. Miami applicants typically interview at the Miami Asylum Office. The application asks for your full persecution story, and inconsistencies can sink a case, so the narrative and evidence should be built carefully before filing. Bring your documents to a consultation and we will map your path.
Missing the deadline does not always end the case. Exceptions exist for changed circumstances in your country or extraordinary circumstances that prevented filing, and withholding of removal and CAT protection have no one-year deadline at all. Do not decide on your own that the door is closed — bring your timeline to a consultation first.

You can legally work in Florida while your asylum case is pending only after you receive an approved Employment Authorization Document (EAD), also known as a work permit.
It depends where you are. An asylum office can refer your case to immigration court rather than end it; a judge's denial can be appealed to the Board of Immigration Appeals, and motions to reopen exist for the right facts. Withholding of removal and CAT protection may still be available. Bring your denial or referral notice to a consultation so we can review the specific basis.
Often, yes. Your spouse and unmarried children under 21 can usually be included as derivatives on your application, and after a grant you can petition for them with Form I-730 if they were not included. Unaccompanied minor children follow a separate process. Tell us who is with you and who is abroad, and we will plan for everyone.
